Different Hats, Rechtsstaat and Integrity
The problem of separation of powers can also be found in practice within One (the same) person wearing socalled different hats. This issue/problem of integrity is embedded in the legal system we inherited (a colonial inheritance). That’s why I can’t entirely blame our own people who inhereted this template. We find this split between the saying and practice: “campaigning is one thing, governing is another”. The same split shows up when we wear one “hat” (symbol of identity or role): which belongs to being the political party leader and another hat which belongs to being the Prime Minister or a minister. But the real truth is—we only have one head.
The word “integrity” comes from integer, meaning whole. Confusion arises when one wears a certain hat which says one thing and the other hat the complete opposite. This type of contradiction also appears when I campaign on one issue and then govern by doing exactly the opposite.
The same divide exists within the concept of Rechtsstaat (rule of law), which—on paper—is based on separation of powers. but in reality for instance the biggest votegetters in the party become the ministers (government) while the smallest vote getters with the least power in the party become the parliamentarians which have to control the government and have to socalled be independent and separate from the government. Obviously the separation of the powers here is as much a fiction as the multiple contradictory hats worn by the same person representing conflicting competencies and interests. In reality, the multiple “hats” are worn by one single head/person, just as the government and parliament are made up of the people of the same party.
So the concept of Rechtstaat Law becomes a virtual or paper reality, because in practice, these things can’t truly be separated (in this fashion). It becomes a form of DoubleThink and Double Talk that confuses the people, because based on common sense (and real living reality), something can’t be one thing in one moment and the complete opposite the next moment. On paper these things can be separated but not in living reality.
This legal system, this rechtsstaat, is virtual: on paper it checks out—but in reality, it’s e full entanglement and contradiction.
The true sense of justice lies within us, not outside on paper.
